Marcus Eriz, 20, has been arrested and charged with murder and attempted murder in the shooting death of his cousin, 6-year-old Aiden Leos. Eriz and his friend, Wynne Lee, 18, are accused of shooting six bullets at Leos and his older brother, Alex, on the afternoon of February 11. Aiden died of injuries at San Diego Medi-Center.

Eriez is suspected of being the shooter and Lee is suspected of being the driver. CBSLA has learned that investigators from the California Highway Patrol watched the couple and followed them out of a restaurant before arresting them outside their home in Costa Mesa. Orange County District Attorney Todd Spitzer told CBSLA that a murder charge could be filed, but a decision on specific charges will be made in the next 48 hours after prosecutors are notified of the evidence gathered by CHP investigators. Police also say they know where the suspects’ vehicle and the firearm used in the shooting are located and are working to secure the firearm.
