Marcus Eriz, 20, has been arrested and charged with murder and attempted murder in the shooting death of his cousin, 6-year-old Aiden Leos. Eriz and his friend, Wynne Lee, 18, are accused of shooting six bullets at Leos and his older brother, Alex, on the afternoon of February 11. Aiden died of injuries at San Diego Medi-Center.

Eriez is suspected of being the shooter and Lee is suspected of being the driver. CBSLA has learned that investigators from the California Highway Patrol watched the couple and followed them out of a restaurant before arresting them outside their home in Costa Mesa. Orange County District Attorney Todd Spitzer told CBSLA that a murder charge could be filed, but a decision on specific charges will be made in the next 48 hours after prosecutors are notified of the evidence gathered by CHP investigators. Joanna Cloonan, Aiden’s mother, was involved in a traffic incident with the drivers of a white Volkswagen station wagon for an unsafe lane change, according to the CHP. Investigators believe a woman was behind the wheel and the man in the passenger seat fired the shot himself. According to sources close to the case, both suspects are in the Orange County jail on bail set at $1 million each. The reward for information leading to the arrest of the suspects is more than $500,000. It is not yet known if anyone will get this opportunity. CHP officials said they planned to hold a press conference on Monday. Cheryl Gish, an O.C. resident, heard the news of the arrest and came with her husband to Aiden’s memorial at the Walnut Avenue Bridge over Interstate 55. I’m thankful they stopped someone, Gish said Sunday in an interview with CBSLA. It won’t bring the little boy back, little Aiden is gone, but I am so grateful that justice has been done. Every time I drive down the highway, I have to cry, said Jessie Palomo, who had brought her children, classmates of Aiden’s, to the memorial service. They lit candles and paid their respects. Now it’s a place everyone knows, unfortunately in a sad and tragic way, Palomo said. But as a community, we must always stick together.
